Established in 1930s, The National Firearms Act (NFA) regulates specific firearms and accessories, including class 3 firearms like suppressors, short-barreled rifles (SBRs), and machine guns.

An NFA transfer legally allows you to transfer ownership of an NFA-regulated item from one entity or individual to another. Approval from the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) is required before the transfer can be finalized. Class 3 firearms include the following categories

Silencers (Suppressors): These are the devices designed to reduce firearm discharge noise.

Short-Barreled Rifles (SBRs): In this category, there are rifles with barrels shorter than 16 inches or an overall length under 26 inches.

Machine Guns: Firearms that can fire multiple rounds with a single trigger pull falls in this category.

Steps for NFA Transfers

1. Purchase your NFA item

Visit Triton Arms to buy your desired NFA item, ensuring you meet all legal ownership requirements. You must possess the NFA item before applying for the NFA Tax Stamp. The Tax Stamp application process cannot be initiative if you haven’t already purchased the item.

2. Complete ATF Form 4473

Complete the updated ATF Form 4473, the Firearms Transaction Record, updated after ATF Final Rule 2021R-05F. This detailed 7-page form collects the buyer's personal information, such as name, address, date of birth, and photo ID. We will assist you in establishing your ATF eform account if you do not already have one.

It also requires the NICS background check transaction number and an affidavit confirming the buyer's eligibility to purchase firearms. Additionally, it records details about the firearm, like make, model, and serial number. The revised form is available for download on the ATF's website, and all FFLs should use the updated version promptly.

3. Make a payment for NFA Tax Stamp

When you buy an NFA item, it requires a tax stamp for each item purchased. The fee for class 3 firearms is $200 per item, while it is $5 for any other weapon (AOW).

4. Generate a fingerprint EFT File

(i) Electronic fingerprinting

When filing an eForm 4, customers must provide fingerprints. Triton Arms offers electronic fingerprinting services to simplify this process. Schedule an appointment for digital fingerprinting, a mandatory step for your ATF Form 4 submission. Since December 23, 2021, eForm 4 has been available for electronic submission, with an estimated approval time of 90 days. Paper fingerprint card processing begins once the ATF receives and scans the card.

(ii) EFT File creation

Our skilled team will assist you in creating an Electronic Fingerprint Transmission (.EFT) file. Using our advanced ten-print scanner and Bayometric’s ATF Live Scan software, we capture digital fingerprints quickly, usually within minutes. This .EFT file is crucial for electronically submitting your fingerprints to the ATF along with your ATF eForm 4 tax stamp application.

(iii) 2 x 2 Picture

5. Submit ATF eForm 4

(i) ATF eForm 4

The ATF eForm 4 is crucial for legally acquiring firearms, serving as the Application for Tax Paid Transfer and Registration. Currently, only Federal Firearms License (FFL) holders can use this application. With the new eForm system, applicants can now easily include electronic copies of their FD-258 fingerprint cards and a digital photo on the Responsible Person tab. (ii) Using the ATF Portal

6. Wait for approval

Wait for Approval After purchasing your NFA item from Triton Arms and submitting ATF Form 4, the ATF will process your application, which may take several months. The average wait time for eForm 4 submissions is about 232 days, while paper submissions take around 312 days. Upon approval, you will receive a tax stamp, granting legal possession of your NFA item.
